Date Filed Document Text
July 9, 2019 Opinion or Order Filing 23 ENDORSED ORDER granting #22 Motion to Appear Telephonically. Under these circumstances, the Court permits the insurance adjuster to participate by telephone. However, if this case does not settle at mediation, the Court reserves the right to schedule another round of mediation requiring the insurance adjuster to appear in person. At that time, if appropriate, the Court will entertain a motion to consider the responsibility of payment for the additional round of mediation. Signed by Judge Virginia M. Hernandez Covington on 7/9/2019. (Covington, Virginia)

June 3, 2019 Opinion or Order Filing 17 ORDER appointing Peter J. Grilli as mediator in this action. Mediation Conference set for August 5, 2019. The Court directs that all counsel, parties, corporate representatives, and any other required claims professionals shall be present at the mediation conference with full authority to negotiate a settlement. The Court does not allow mediation by telephone or video conference. Personal attendance is required. See Local Rule 9.05(c). Signed by Judge Virginia M. Hernandez Covington on 6/3/2019. (DLB)
June 3, 2019 Filing 16 NOTICE of mediation conference/hearing to be held on 8/5/19 at 1:30 p.m. before Peter J. Grilli.(Kohlmyer, Ernest)
May 30, 2019 Opinion or Order Filing 15 ENDORSED ORDER: In her Unopposed Motion to Extend Mediation Deadline and Schedule Mediation, Plaintiff Kara Paula states, "only four half-day time slots, and one full day, are currently available within the time proscribed for mediation by this Court; none after July 10, 2019." (Doc. #14 at 2). However, a review of Peter Grilli's online calendar reveals July 12, 2019, is available. Although scheduling mediation for this day would require the parties to file their answers to the Court's interrogatories before their deadlines, see (Doc. #12 at 3-4), doing so will allow the parties to comply with the Court's other deadlines. Furthermore, the Court spoke with Peter Grilli's office and was advised that August 5, 2019 - which is currently marked as "On Hold" on the online calendar - would be an available option for the parties upon request. Finally, even if an extension is needed, multiple days in August are available for the parties to mediate, so it is not clear why the parties selected August 29, 2019, to conduct mediation. The parties are therefore directed to try again to schedule mediation before the August 6, 2019, deadline, as outlined in this Order. For these reasons, Paula's Unopposed Motion to Extend Mediation Deadline and Schedule Mediation is denied without prejudice. Signed by Judge Virginia M. Hernandez Covington on 5/30/2019. (DLB)
May 29, 2019 Filing 14 Unopposed MOTION to extend time to conduct mediation and schedule mediation for August 29, 2019 at 1:30 PM by Kara Paula. (Geiger, Bryan)
May 28, 2019 Opinion or Order Filing 13 ENDORSED ORDER: On May 13, 2019, the Court entered its scheduling order, directing the parties to file a notice of mediation by May 22, 2019. (Doc. #12). A review of the docket reveals that no notice has been filed. Accordingly, the parties are again directed to file a notice of mediation, indicating the date, time, and location of the mediation conference, by May 30, 2019. Signed by Judge Virginia M. Hernandez Covington on 5/28/2019. (DLB)
May 13, 2019 Opinion or Order Filing 12 SCHEDULING ORDER: The parties are directed to adhere to the Court's Scheduling Order. This action is hereby referred to Peter J. Grilli, Esq., for mediation. The parties must mediate no later than August 6, 2019. Lead Counsel shall file a notice of mediation informing the Court as to the date, time, and location of mediation by May 22, 2019. Neither party may reschedule or cancel the mediation conference once it is set; leave of Court must be obtained before the mediation conference may be rescheduled or cancelled. The parties shall not mediate until the information exchange outlined in the Scheduling Order is completed. Absent compelling circumstances and leave of Court, lead counsel must appear at the mediation conference. Lead Counsel shall file a notice informing the Court as to the results of mediation within 24 hours of the mediation conference. In the event mediation results in an impasse, the parties must file their jointly-prepared fast-track case management report within 24 hours of the mediation conference. Upon review of the jointly-prepared case management report, the Court will determine whether a case management hearing is necessary. If a case management hearing is necessitated, the Court will set the hearing by separate notice. Furthermore, if mediation results in an impasse, the Court intends to schedule this action for trial within 90-120 days from the mediation conference. Signed by Judge Virginia M. Hernandez Covington on 5/13/2019. (TWL)
