In light of Defendant's response agreeing to the motion to remand (Doc. #12), the Court finds that remand to state court is proper. However, the Court declines to award the requested attorney's fees and costs. Consequently, this action is REMANDED to state court. Because this action is remanded, "Plaintiff's Motion to Stay all Deadlines Pending the Court's Ruling on Plaintiff's Motion for Remand" (Doc. #11) is hereby denied as moot.
