Please be advised that the Court's Case Management Report form is different from those used by other judges. Local Rule 3.05(c)(2)(E), M.D. Fla., explains that most track two cases, like the present case, "will be tried within one year after the filing of the complaint." To accomplish this goal, the Court believes that six to eight months is a sufficient period of time to conduct discovery. Filing 9 ENDORSED ORDER: On November 12, 2019, Mehta filed a proof of service indicating that he served Erin Fatica, as Acting Field Office Director for U.S. Customs and Immigration Services, by sending her a copy of the summons and complaint by certified mail. (Doc. #7). The next day, Mehta filed another proof of service indicating that he sent a copy of the summons and complaint to the United States Attorney for this district by certified mail. (Doc. #8). To properly serve a United States agency or employee sued in an official capacity, a plaintiff must comply with Federal Rule of Civil Procedure 4(i)(2), which requires that the plaintiff "serve the United States and also send a copy of the summons and of the complaint by registered or certified mail to the agency, corporation, officer, or employee." Fed. R. Civ. P. 4(i)(2). To serve the United States, a plaintiff must serve the summons and complaint on the United States Attorney for the district where the action is brought as well as send a copy of each by registered or certified to the Attorney General in Washington, D.C. Fed. R. Civ. P. 4(i)(1). While the service documents on the docket show that Mehta has delivered the summons and complaint to Fatica and the United States Attorney for this district, Mehta has yet to file a notice or proof of service showing that he has sent a copy of the summons and complaint to the Attorney General in Washington, D.C., as required by Rule 4(i)(1)(B). Thus, at this juncture, the Court is not convinced that Mehta has properly served the United States. Accordingly, Mehta is directed to provide more information concerning his efforts to serve the United States in accordance with Rule 4(i)(1) by November 25, 2019. Signed by Judge Virginia M.
