April 15, 2020 Opinion or Order Filing 14 ENDORSED ORDER denying #12 Defendant's Motion to Vacate and/or Reconsider Doc. 10. The Defendant has not demonstrated an adequate basis for such relief, including a particularized showing of prejudice. In this regard, as provided in the Court's Order (Doc. #10), the Defendant has the right to challenge the subpoena by way of a motion to quash and/or for a protective order, and the internet service provider (ISP) has been specifically directed in the Order that it "shall not disclose the subpoenaed information to Strike 3 until the Court has resolved the subscriber's challenge." The Defendant may file any such motion within thirty (30) days of the date of this Order. Given the Defendant's objection to the subpoena, however, the Court hereby orders that the ISP shall not provide the subpoenaed information to the Plaintiff until such time as the Court resolves the Defendant's anticipated motion or until further order of the Court.
