September 30, 2020 Opinion or Order Filing 10 ENDORSED ORDER: Plaintiff Vargas initiated this action on August 24, 2020. (Doc. #1). The Court ordered Vargas to effect service of process within ninety days and thereafter file proof of service with the Court pursuant to Federal Rule of Civil Procedure 4. (Doc. #5). Counsel for the defendant filed a notice of appearance on September 23, 2020. (Doc. #6). On September 28, 2020, the Court reminded Vargas to file proof of service or proof of waiver. (Doc. # 7). The next day Vargas filed a return of service executed on September 4, 2020. (Doc. #9). Therefore, Defendant Sojack's answer was due September 25, 2020. A review of the record reveals that Sojack has not responded to the complaint, and that Vargas has not promptly applied to the Clerk for entry of default pursuant to Local Rule 1.07(b). Vargas is therefore directed to show cause by October 7, 2020, why this action should not be dismissed for failure to prosecute pursuant to Local Rule 3.10(a). Signed by Judge Virginia M. This document can be found on Judge Covington's page of the Court's website at www.flmd.uscourts.gov. Please be advised that the Court's Case Management Report form is different from those used by other judges. Local Rule 3.05(c)(2)(E), M.D. Fla., explains that most track two cases, like the present case, "will be tried within one year after the filing of the complaint." To accomplish this goal, the Court believes that six to eight months is a sufficient period of time to conduct discovery. If the parties believe that more time than eight months will be needed to complete discovery, the parties should provide the Court with a detailed explanation as to why additional time is needed and a timeline for the discovery that is planned.
