November 17, 2020 Opinion or Order Filing 4 ENDORSED ORDER: On November 17, 2020, Defendant USAA General Indemnity Company removed the case from state court on the basis of diversity jurisdiction. (Doc. #1). However, the Complaint does not specify the amount of damages sought, and when "damages are unspecified, the removing party bears the burden of establishing the jurisdictional amount by a preponderance of the evidence." Lowery v. Ala. Power Co., 483 F.3d 1184, 1208 (11th Cir. 2007). USAA General argues that damages exceed $75,000 because the insurance policy at issue has a limit of $100,000. (Doc. #1 at 2-4). However, USAA General provides no concrete factual support that Plaintiff Mia N. Sanchez's damages exceed $75,000. Therefore, the Court is unable to determine whether the amount in controversy has been met by Sanchez's damages claim without engaging in heavy speculation. Accordingly, USAA General is directed to provide the Court with more information by November 24, 2020, regarding the amount of damages in order to establish that the amount in controversy has been satisfied.
