Filing 11 ENDORSED ORDER: On July 2, 2021, Plaintiff Fresenius Vascular Care, Inc. filed a return of service for Defendant National Medical Care, Inc., indicating that service was executed on June 25, 2021. (Doc. #7). That same day, Fresenius filed a return of service for Defendant Indi Vasudeva indicating that service was executed on June 29, 2021. (Doc. #8). Accordingly, National Medical Care's answer was due on July 16, 2021, and Vasudeva's answer was due on July 20, 2021. When no answers were filed and those deadlines passed, it would have been appropriate for Fresenius to promptly move for Clerk's default. Yet a review of the docket shows that Fresenius has not yet done so, and instead only moved to excuse the case management report deadline. (Doc. #10). The Court grants Fresenius's request and excuses the case management report deadline. But the Court advises Fresenius that should it fail to move for Clerk's default forthwith, the Court will generate an order to show cause why sanctions should not be imposed for failure to prosecute.
