As explained, Plaintiff's Complaint violates the rule against improper claim-splitting and does not properly invoke the Court's subject matter jurisdiction. Plaintiff continues to acknowledge that diversity of citizenship does not exist between the Plaintiff and the Defendant. (Dkt. 5 at 3) Diversity of citizenship is required to invoke this Court's jurisdiction under 28 U.S.C. 1332.
