October 7, 2021 Opinion or Order Filing 4 ENDORSED ORDER: Plaintiff has filed her complaint in this Court on the basis of diversity jurisdiction. (Doc. #1). Yet, Plaintiff has not sufficiently alleged the parties' citizenships. As to Plaintiff and the individual Defendants, Plaintiff merely alleges the state in which each is a "resident." But "[f]or purposes of diversity jurisdiction, 'citizenship' means 'domicile.'" Audi Performance & Racing, LLC v. Kasberger, 273 F. Supp. 2d 1220, 1226 (M.D. Ala. 2003)(citation omitted). "In fact, it is a party's domicile rather than his residence which is determinative of citizenship for diversity jurisdiction." Id. (citations omitted). Regarding Defendant Plutus Enterprises, LLC, Plaintiff merely alleges it is an Alabama limited liability company with a principal place of business in Alabama. But "a limited liability company is a citizen of any state of which a member of the company is a citizen." Rolling Greens MHP, L.P. v. Comcast SCH Holdings L.L.C., 374 F.3d 1020, 1022 (11th Cir. 2004). Thus, "[t]o sufficiently allege the citizenships of" a limited liability company, "a party must list the citizenships of all the members of the limited liability company." Id. In order to establish this Court's jurisdiction, Plaintiff must file an amended complaint that properly establishes each party's citizenship by October 13, 2021. Signed by Judge Virginia M.
