February 16, 2022 Opinion or Order Filing 7 ENDORSED ORDER: Upon review, the Court believes the complaint constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1320-23 (11th Cir. 2015). Specifically, Plaintiff's second Count re-alleges almost all of the preceding allegations, including those in the first count, despite their apparent irrelevance to the relief sought through the second Count. Cf. Paylor v. Hartford Fire Ins. Co., 748 F.3d 1117, 1126 (11th Cir. 2014) (noting that a shotgun pleading incorporates irrelevant allegations from previous counts). This type of pleading might prevent "adequate notice of the claims against [Defendant] and the grounds upon which each claim rests." See Weiland, 792 F.3d at 1323. Accordingly, no later than February 23, 2022, the Court orders Plaintiff to show cause why the Court should not strike the complaint as an impermissible shotgun pleading. In the alternative, Plaintiff may file an amended complaint remedying the above deficiency. Signed by Judge Kathryn Kimball Mizelle on 2/16/2022. (SMR)
February 15, 2022 Opinion or Order Filing 6 STANDING ORDER regarding discovery motions. Signed by Magistrate Judge Thomas G. Wilson on 2/1/2021. (DMS)
