May 25, 2022 Opinion or Order Filing 21 ENDORSED ORDER: The Court appears to be not understanding. Mr. Hill should please set forth why the cause of action was not removable at early as 11/22/21 when the First Amended Complaint was filed. See Doc. 12-4. At that time Plaintiff stated the amount sought was $65,015 exclusive of interest, costs, and attorneys fees. At that time Plaintiff brought a one count complaint for retaliation under Fla. Stats. 448.102. At that time Plaintiff prayed for back pay, front pay, compensatory damages, punitive damages, attorneys fees, costs, and interest. Why was the complaint not removable then but was removable on April 5, 2022? On April 5 the Plaintiff's Second Amended Complaint stated again it sought $65,015 exclusive of interest, costs, and attorneys fees. See Doc. 12-8. And Plaintiff again filed a one count complaint for retaliation under the Florida statute, praying for the same damages, i.e. back pay, front pay, compensatory damages, punitive damages, attorneys fees, costs, and interest. What made the April 5 SAC removable that was not present in the November 22 FAC? Please respond no later than 3:00 pm May 27, 2022. Plaintiff may also file a brief response by that time.
