Date Filed Document Text
September 1, 2023 Opinion or Order Filing 14 ENDORSED ORDER denying #12 Motion for Leave to Appeal In Forma Pauperis: The Complaint is without merit in fact or law, and not amenable to cure. Because it is frivolous, it is not brought in the good faith necessary to sustain an in forma pauperis proceeding. See 28 U.S.C. 1915(3). Plaintiff may seek in forma pauperis status from the Court of Appeals but at the District Court level the motion is denied. Signed by Judge William F. Jung on 9/1/2023. (Jung, William)
September 1, 2023 Opinion or Order Filing 13 ENDORSED ORDER denying #11 Motion to recuse District Judge. The Court has reviewed this record and the appropriate case law concerning the recusal statute, 28 U.S.C. 455. See generally McWhorter v. City of Birmingham, 906 F.2d 674, 678 (11th Cir. 1990); Liteky v. United States, 510 U.S. 540, 555 (1994)("judicial rulings alone almost never constitute a valid basis for a bias or partiality motion"). No proper grounds for recusal are shown under the standards of the statute and case law. The Court dismissed the underlying complaint brought by Ms. Jones listing as her other named Plaintiff Jesus Christ, against scores of defendants including Satan, the Pope, Oprah Winfrey, the FBI, Alcoholics Anonymous, Kanye West, Beyonce, and 280 others. The complaint was frivolous and not amenable to cure. Signed by Judge William F. Jung on 9/1/2023. (Jung, William) Modified on 9/1/2023 (Jung, William).

July 31, 2023 Opinion or Order Filing 6 ENDORSED Order dismissing case as frivolous; ordering Clerk to close this matter. The first named plaintiff in this 315 page complaint is "Jesus Christ, Lord, All Mighty God of Heaven, Kingdom of Light." The other named plaintiff is Ms. Jones. There are 285 defendants listed here; the first named defendant is Satan. This defendant group includes Pope Francis, Beyonce, Oprah Winfrey, Kanye West, the FBI, Alcoholics Anonymous, Wells Fargo Bank, Whoopi Goldberg, the Philadelphia, Pa. Police Department, and a large number of other celebrities, religious prelates and preachers, and business and similar entities. The two plaintiffs seek $10.5 trillion in compensatory and punitive damages. The gist of the allegations are that defendants are part of a satanic occult or conspiracy. Defendants include false Christians who serve defendant Satan. They engage in witchcraft and Ms. Jones states "bewitchment was to keep me spiritually ignorant in sin and to escort my soul to Hellfire." Doc. 1 at 62, 64. In this complaint Ms. Jones may indeed make some good ecclesiastical points and she is a sincere person. Regrettably this is not the forum to bring such complaints. The complaint does not state a claim under Federal Rule of Civil Procedure 8. It is not amenable to cure; the case is dismissed with prejudice. The Clerk will close this file. Signed by Judge William F. Jung on 7/31/2023. (Jung, William) Modified on 7/31/2023 (Jung, William).
