Date Filed Document Text
December 20, 2023 Opinion or Order Filing 6 ENDORSED ORDER dismissing case with prejudice. The Clerk will terminate motions and close. In this matter, no filing fee or motion for in forma pauperis consideration has been filed. Plaintiff Father seeks an emergency order to have holiday visitation with his son in a domestic matter. The Plaintiff seeks an order compelling the Pinellas domestic relations judge to permit same, and an injunction requiring that Pinellas domestic relations judge to recuse himself. He cites Florida, federal, and United Nations law grounds, noting that the denial of holiday visitation intrudes upon these rights. Doc. 2 at 3. The Plaintiff requests from the undersigned "a thorough judicial review of [Pinellas domestic relations] Judge Steve D. Berlin's handling of the case" to make sure the rules and Plaintiff's rights are respected, and Plaintiff can get holiday visitation with his son. He asks the undersigned to take over this family law matter from the Pinellas Courts. Doc. 3 at 2. Plaintiff also objects to the domestic relations judge dismissing "disturbing images I submitted depicting a situation involving my son's mother's twin brother, despite their alarming nature." Doc. 3 at 1. Also the former wife has not participated appropriately in the domestic litigation. Id. at 2. Regrettably this Court has no power to superintend Judge Berlin or assume control of this domestic relations case. This Court cannot interfere in state domestic relations matters. Plaintiff should seek relief in the state court system, in Pinellas County and in the Second District (Florida) Court of Appeals. Federal courts do not sit in review of state domestic relations courts and have no such power. Plaintiff should devote his effort to the state system and seek relief there. Signed by Judge William F. Jung on 12/20/2023. (Jung, William)
