Date Filed Document Text
May 29, 2024 Filing 22 MOTION for Clarification re 21 Order on Motion to Reopen Case #20 Time Sensitive MOTION to Reopen Case , MOTION for Show Cause Order, and MOTION for other Injunctive Relief by Roderick Ford. (Ford, Roderick)
May 28, 2024 Opinion or Order Filing 21 ENDORSED ORDER: Ford's #20 Expedited Motion is DENIED to the extent Ford seeks sanctions or an order to show cause for violation of the Court's prior order. To the extent Ford requests that the Court reopen this case and reargue the merits of his appeal, this Court lacks jurisdiction to consider that request given the pending appeal. See Griggs v. Provident Consumer Disc. Co., 459 U.S. 56, 58 (1982) (explaining that the filing of a notice of appeal generally "confers jurisdiction on the court of appeals and divests the district court of its control over those aspects of the case involved in the appeal"); see also Doe, 1-13 ex rel. Doe Sr. 1-13 v. Bush, 261 F.3d 1037, 1064-65 (11th Cir. 2001) ("[A]s a general rule, the filing of a notice of appeal divests the district court of jurisdiction over those aspects of the case that are the subject of the appeal," but "it may not divest the district court of jurisdiction over collateral matters not affecting the questions presented on appeal."). Thus, any request to open this case is DENIED for lack of jurisdiction. Signed by Judge Kathryn Kimball Mizelle on 5/28/2024. (ALE)
