ENDORSED ORDER remanding case for lack of subject matter jurisdiction. Defendant removed the case under "federal question" jurisdiction. But the complaint includes no federal claims, only two state law tort actions. The Court required Defendant to show cause why remand should not be imposed due to lack of subject matter jurisdiction. The Response does not support jurisdiction in federal court. State tort claims are not federal constitutional claims, even if they are considered (under a state law rule) to use analogous federal law for much of the issues under adjudication. Defendant cites a Florida state case as the grounds for jurisdiction here. Florida state court interpretations of Florida legal procedure do not create subject matter jurisdiction in federal court. This Court is one of limited jurisdiction, which does not presently exist under the complaint as removed. The Clerk will remand, close this case, and terminate motions. Signed by Judge William F.
