Filing 5
ENDORSED ORDER denying #4 Plaintiff's motion for extension of time to file amended complaint. On April 9, 2025, the Court dismissed #2 Plaintiff's complaint as frivolous and directed the Clerk to enter judgment and close the case. As the Court noted, Plaintiff alleged that "over the past three years, prison officials at six separate facilities ha[d] inserted 'half sticks of tubes' into the walls as part of a conspiracy to poison him, force medication on him, record his movements, steal his personal information, and cause the disappearance of family members." The Court did not grant Plaintiff leave to file an amended complaint. See Tazoe v. Airbus S.A.S., 631 F.3d 1321, 1336 (11th Cir. 2011) (district court not required to grant leave to amend "if the claim is patently frivolous or if amendment would be futile"). Plaintiff now seeks #4 an extension of time to file an amended complaint. Because Plaintiff was not granted leave to amend, and because any amended complaint based on Plaintiff's frivolous allegations would be futile, the Court denies the extension motion. This case remains closed. Signed by Judge William F. Jung on 5/13/2025. (MWC)
