ORDER: The complaint (Doc. #1) is dismissed without prejudice, with leave to amend. Plaintiff Olga Cristina Webster Alexander is directed to file an amended complaint to cure the defects identified in this Order on or before December 10, 2025. The amended complaint should not include Ole Ventures Inc. or Ole Travel Inc. as plaintiffs and should not assert any claims on their behalf. The failure to file an amended complaint as directed will result in this Order becoming a final judgment. Because the complaint has been dismissed, Plaintiff's motions for leave to effect alternative service (Docs. #12; #13) are denied without prejudice. ENDORSED ORDER TO SHOW CAUSE: Based on the complaint (Doc. #1) and Plaintiff Olga C. Alexander's "Errata and Clarification" in her "Motion to Designate Related Case and for Alternative Service" (Doc. #9), the Court has serious concerns related to the exercise of subject matter jurisdiction and venue. In particular, the Court notes that the only claims in this case are those of Plaintiff Olga C. Alexander. Although she identified herself as a "resident" of Florida and California and a "citizen" of the United States in the complaint, in the "Errata," she identifies herself as a citizen of Peru. She describes Defendants as "residents" of Georgia in the complaint. Citizenship is therefore not properly alleged as to any party in the complaint (meaning that the Court lacks subject matter jurisdiction). See Smith v. Marcus & Millichap, Inc., 991 F.3d 1145, 1149 (11th Cir. 2021) (citing McCormick v. Aderholt, 293 F.3d 1254, 1257 (11th Cir. 2002)). Moreover, it is unclear what connection, if any, Florida has to the present dispute (meaning that this district court may not be the proper venue for this dispute). See 28 U.S.C. 1391(b)(1); (b)(2). Consequently, Plaintiff is directed to SHOW CAUSE - in a written response that does not exceed seven pages - as to why the Court should not dismiss this case for either lack of subject matter jurisdiction or improper venue. Plaintiff must file her written response on or before October 3, 2025, and failure to respond as directed will result in the dismissal of this case without prejudice without further notice. ENDORSED ORDER: Plaintiff's "Motion to Designate Related Case and for Alternative Service" (Doc. #9) is hereby denied. To the extent Plaintiff seeks to consolidate this case with a case in another district (either in federal or state court), cases in different districts cannot be consolidated. If Plaintiff wishes to pursue her claims in California, she may file a notice of voluntary dismissal to dismiss the instant case without prejudice. To the extent Plaintiff seeks substitute service, the motion is denied without prejudice for failure to comply with Local Rule 3.01. In an abundance of caution, the Court will extend its prior deadline to file returns of service. Instead, on or before October 3, 2025, Plaintiff must file either (1) the returns of service or (2) a separate motion for substitute service, including a memorandum of law.
