TEXT ORDER. Defendant Equifax Information Services LLC's #36 Amended Stipulation of Dismissal with Prejudice as to Defendant Equifax Information Services LLC is STRICKEN. As stated in the Court's prior Order, an answer has been filed so a dismissal of Equifax may only be effected via "a stipulation of dismissal signed by all parties who have appeared." See Fed. R. Civ. P. 41(a)(1)(A)(ii). Defendant Equifax's amended filing again incorrectly cites Rule 41(a)(1)(A)(i). (Doc. #36). What is more, Federal Rule of Civil Procedure 41(a)(1) provides that "the plaintiff may dismiss an action," not the defendant. Fed. R. Civ. P. 41(a)(1) (emphasis added). As also repeated in the Court's prior Order, Equifax has already been dismissed from this case. (Doc. 29). It is unclear why Defendant Equifax continues to file stipulations on the docket that fail to comply with Rule 41. Accordingly, the Clerk of Court is DIRECTED to STRIKE Defendant Equifax Information Services LLC's Amended Stipulation of Dismissal with Prejudice (Doc. #36) and add a notation to the docket text stating that the document was stricken by this Order. TEXT ORDER striking #34 Defendant Equifax Information Services's Stipulation of Dismissal with Prejudice. Federal Rule of Civil Procedure 41 provides that a plaintiff may dismiss an action without a court order by filing "a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment." Fed. R. Civ. P. 41(a)(1)(A)(i) (emphasis added). Because an answer has been filed (see Doc. #23), a voluntary dismissal without court order may only be effected via "a stipulation of dismissal signed by all parties who have appeared." Fed. R. Civ.
