ORDER: No later than December 5, 2025, and in a brief no longer than five (5) pages, Hicks must explain why this action should not be dismissed for lack of subject matter jurisdiction. Specifically, Hicks should address whether the ADA applies to defendants, and thus whether Hicks's request for written communication was a "statutorily protected expression" under the ADA. Frazier-White v. Gee, 818 F.3d 1249, 1258 (11th Cir. 2016). The Court defers ruling on Defendants Audacy and Audacy Operations' Motion to Dismiss the Second Amended Complaint (Doc. #77) and Hicks's Motions for Sanctions (Doc. #65), for Court Supervision (Doc. #84), and for Alternative Service (Doc. #85), pending Hicks's response to this Order. Hicks's deadline to serve Defendant Brian Howie is accordingly STAYED. Defendants' Amended Motion to Continue (Doc. #79) is GRANTED. ENDORSED ORDER denying without prejudice Plaintiff's #53 Motion for Leave to File Second Amended Complaint. First, Plaintiff does not demonstrate that justice requires amendment. See Fed. R. Civ. P. 15(a)(2). Plaintiff asserts that he must amend his complaint based on inaccuracies in Defendants' corporate disclosure statement. But, Defendants have not filed their disclosure statement and informed Plaintiff that the document he reviewed had not been finalized. Doc. 53, p. 22. Thus, any response to the content of the document appears premature. Second, Plaintiff did not fulfill his obligation to confer with opposing counsel in a good-faith attempt to resolve the motion prior to filing it. See Local Rule 3.01(g) (M.D. Fla.). Rule 3.01(g) is designed to conserve both Court and party resources. Here, Plaintiff's 3.01(g) certification and attached documents indicate that Defendants had not yet taken a position on Plaintiff's motion and would do so after their counsel reviewed it.
