August 21, 2025 Opinion or Order Filing 2 ENDORSED ORDER: Petitioner pled guilty to two counts of mailing a threatening communication and received a total sentence of 41 months' imprisonment. United States v. Thompson, No. 8:22-cr-438-SDM-CPT, Doc. 43 (M.D. Fla.). His appeal of those convictions remains pending in the Eleventh Circuit. United States v. Thompson, Nos. 25-10058, 25-10134, 25-10176, 25-10225 (11th Cir.). Petitioner initiated the present action by filing a pro se petition for writ of habeas corpus. In it, he appears to raise several challenges to the validity of his convictions. Because Petitioner's direct appeal remains pending, this Court lacks jurisdiction over any collateral attack on his convictions. See United States v. Dunham, 240 F.3d 1328, 1329 (11th Cir. 2001) (holding that district court "lacked jurisdiction to consider and rule on [defendant's 28 U.S.C. 2255] motion during the pendency of her direct appeal"). Therefore, this action is DISMISSED without prejudice for lack of jurisdiction. The Clerk is directed to CLOSE this case. Once his direct appeal concludes, Petitioner may (if appropriate) seek collateral relief by filing a motion to vacate under 28 U.S.C. 2255 in a new case with a new case number.
