August 22, 2025 Opinion or Order Filing 2 ENDORSED ORDER: Petitioner is a Florida prisoner serving a life sentence for sexual battery on a child under twelve and lewd or lascivious molestation of a child under twelve. He initiated this action by filing a document titled "Petition Seeking Belated Appeal or Discretionary Review." According to Petitioner, the attorney who represented him in the Second District Court of Appeal "misadvised [him] as to the opportunity for seeking discretionary review" in the Florida Supreme Court. (Doc. #1 at 11). Under Florida law, "[p]etitions seeking belated review must be filed in the court to which the appeal or discretionary review should have been taken." Fla. R. App. P. 9.141(c)(3). Thus, to the extent he seeks belated discretionary review, Petitioner must file his petition with the Florida Supreme Court. The Clerk is directed to CLOSE this case. Signed by Judge William F.
