ENDORSED ORDER: A previous order dismissed the complaint without prejudice and provided Plaintiff with leave to amend no later than September 18, 2025. (Doc. 2). The deadline has passed, and Plaintiff has neither sought an extension nor filed an amended complaint. As a result, the order dismissing the complaint has "become[] a final judgment." Auto. Alignment & Body Serv., Inc. v. State Farm Mut. Auto. Ins. Co., 953 F.3d 707, 719-720 (11th Cir. 2020). Accordingly, the plaintiff's action is DISMISSED WITHOUT PREJUDICE. The clerk is directed to enter judgment, which shall read "This case is dismissed without prejudice." The clerk is directed to CLOSE the case. Signed by Judge Kathryn Kimball Mizelle on 9/24/2025. Filing 2
ENDORSED ORDER: Upon review, the Court finds this complaint constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1320 (11th Cir. 2015). Specifically, the plaintiff fails to separate "into a different count each cause of action or claim for relief." Id. at 1323. Accordingly, the plaintiff's complaint is DISMISSED without prejudice, and the plaintiff is granted leave to amend the complaint no later than September 18, 2025. In any amended complaint, the plaintiff must: (1) plead his complaint in separate claims for relief and include no more than one claim for relief in each count of the amended complaint; (2) state above each count in the form of a title or a heading the name of one and only one claim for relief that the count alleges; (3) separate or identify the facts that support each count from the facts that support another count or counts; and (4) in each claim state the relief to which, based on the claim, the plaintiff claims entitlement. Beyond addressing the issues noted above, the plaintiff must also identify a basis for federal subject-matter jurisdiction. Finally, the plaintiff has neither paid the required filing fee nor moved to proceed in forma pauperis. No later than September 18, 2025, the plaintiff must either pay the full $405 filing fee or move to proceed in forma pauperis. The failure to comply with this order will result in dismissal of this action without prejudice. Signed by Judge Kathryn Kimball Mizelle on 9/4/2025. (BTM)
