ENDORSED ORDER: Upon review, the Court finds this #2 Complaint impermissibly "contain[s] multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint."). Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1321 (11th Cir. 2015). The Court DISMISSES the operative #2 Complaint and GRANTS plaintiff leave to amend no later than October 29, 2025. In addition, the Court notes that the complaint lists "John Does 1-10". Complaint at 17. In amending the complaint, the plaintiff shall show why the complaint should not be dismissed as to the unnamed parties. See Richardson v. Johnson, 598 F.3d 734, 738 (11th Cir. 2010) ("As a general matter, fictitious-party pleading is not permitted in federal court."). See also FRCP 10(a). The Court notes that in some circumstances, a plaintiff may sue an unnamed party whose identity will not be known prior to the filing of the complaint. See Jane Doe v. Salesforce, et al., No. 8:24-CV-01678-SDM-NHA, 2025 WL 2879524 (M.D. Fla. Oct. 9, 2025) (citing Bowens v. Superintendent of Miami S. Beach Police Dep't, 557 F. App'x 857, 862 (11th Cir. 2014)). However, the complaint must describe the unnamed defendants with enough specificity to enable service of process. Castle v. Cobb Cnty, Georgia, No. 22-12156, WL 3772501, at *1 (11th Cir. June 2, 2023) (per curiam). Here, plaintiff neither names "John Does 1-10" nor specifies what counts are relevant to them. See Weiland, 792 F.3d at 1323 (noting the mistake of "asserting multiple claims against multiple defendants without specifying which of the defendants are responsible for which acts.").
