Date Filed Document Text
October 22, 2025 Filing 3 NOTICE of Local Rule 1.11(e), which provides that, unless an order states another time, a seal under Rule 1.11 expires ninety days after a case is closed and all appeals are exhausted. To prevent the content of a sealed item from appearing on the docket after the seal expires, a party or interested non-party must move for relief before the seal expires. (Signed by Deputy Clerk). October 21, 2025 Opinion or Order Filing 2 ENDORSED ORDER: On October 20, 2025, Plaintiff Zechariah Arthur Hill filed the instant case in which he appears to claim that Defendants violated 11 USC 362, 11 USC 1301, 11 USC 1325, and the Section One of the Fourteenth Amendment through some unspecified actions related to a bankruptcy filed by Plaintiff on September 30, 2025. He specifically requests an emergency stay of any attempt by Defendant H2 Property Holding LLC to retake possession of or evict Plaintiff from certain real property located in Bradenton, Florida. To the extent that Plaintiff claims any violations of the automatic stay imposed by the Bankruptcy Code, he may not pursue an independent cause of action in federal district court and must instead pursue remedies within his bankrtupcy case. To the extent that he is seeking to enjoin any actions within a state court case, the Court lacks subject matter jurisdiction over such claims. See Claughton v. Donner, 771 F. Supp. 1200, 1203 (S.D. Fla. 1991) ( "[U]nder the Anti-Injunction Act, 28 U.S.C. 2283, '[a] court of the United States may not grant an injunction to stay proceedings in a State court except as expressly authorized by Act of Congress, or where necessary in aid of its jurisdiction, or to protect or effectuate its judgments) (quoting Younger v. Harris, 401 U.S. 37, 40 (1971)). Consequently, this case is dismissed. The Clerk is directed to terminate any pending motions and deadlines, and thereafter close this case. Signed by Judge Thomas P. Barber on 10/21/2025. (ANL)
