April 1, 2026 Opinion or Order Filing 21 ENDORSED ORDER: Plaintiff's #20 Motion for Extension of Time is DENIED. Plaintiff's second amended complaint was dismissed as a shotgun pleading over two months ago, and since that time Plaintiff has received three separate extensions to obtain counsel and file a third amended complaint. The Court's previous order warned Plaintiff that failure to timely file a third amended complaint would subject the action to dismissal without further notice. See (Doc. 19). Because Plaintiff failed to file a complaint, this action is DISMISSED. January 30, 2026 Opinion or Order Filing 13 ENDORSED ORDER: Upon review, the Court finds that Plaintiff's #12 Second Amended Complaint constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1324 (11th Cir. 2015). Specifically, the complaint's allegations are not listed in individually numbered paragraphs, Fed. R. Civ. P. 10(b), and contain "conclusory, vague, and immaterial facts not obviously connected to any particular cause of action," Weiland 792 F.3d at 1322. For example, Plaintiff alleges that defendant Melisa Mangelli used Plaintiff's "privacy and personal ID" to file a "fraudulent Affidavit of Grantor in official court records" but does not allege facts showing harm from that action where the "Plaintiff did not own" the property in question. 2d Am. Compl. at 5. Separately, Plaintiff includes facts and claims about a seemingly unrelated transaction from two years later, in which defendant US Bank National Trust National Association made "harassing calls" and issued "billing correspondence addressed in a deceased name." Id. Federal Rule of Civil Procedure 20(a) "precludes a plaintiff from joining unrelated claims against various defendants unless the claims arose out of the same transaction." Smith v. Owens, 625 F. App'x 924, 928 (11th Cir. 2015) (per curiam). Accordingly, Plaintiff's complaint is DISMISSED without prejudice, and the Plaintiff is granted leave to amend her complaint one final time no later than February 13, 2026. If the Plaintiff fails to amend the complaint or submits another shotgun pleading that joins unrelated claims against unrelated defendants, this action will be dismissed without further notice. December 4, 2025 Opinion or Order Filing 4 ENDORSED ORDER: Upon review, the Court finds this complaint constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1324 (11th Cir. 2015). Specifically, each count improperly "incorporates and adopts by reference the allegations in" the prior counts leading to a situation where counts II through VII contain irrelevant factual allegations and legal conclusions. See id. at 1321 ("The most common type [of shotgun pleading]--by a long shot--is a complaint containing multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint."). Accordingly, the Plaintiff's complaint is DISMISSED, and the Plaintiff is granted leave to amend their complaint no later than December 18, 2025.
