December 9, 2025 Opinion or Order Filing 5 ENDORSED ORDER dismissing without prejudice defendant's #4 Amended Complaint. The plaintiff filed an amended complaint, (Doc. #4), but it does not redress the errors identified in the previous order. The complaint must "separate[e] into a different count each cause of action or claim for relief." See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1322-23 (11th Cir. 2015). Further, the amended complaint does not describe events that occurred with specificity. As a result, like her initial complaint, the plaintiff's amended complaint is a shotgun pleading. Accordingly, the complaint is DISMISSED without prejudice, and plaintiff is granted leave to amend her complaint no later than December 23, 2025. November 21, 2025 Opinion or Order Filing 3 ENDORSED ORDER: The Court DISMISSES Plaintiff's #1 Complaint without prejudice because it is a shotgun pleading. Specifically, Plaintiff does "not separate[e] into a different count each cause of action or claim for relief."). See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1322-23 (11th Cir. 2015). For example, Plaintiff files the claim under the Eighth Amendment. She then describes alleged wrongdoing by different actors without separating the allegations into different counts, or specifying what provisions the actors violated. Accordingly, Plaintiff's complaint is DISMISSED, and Plaintiff is granted leave to amend her complaint no later than December 5, 2025.
