ORDER. The Magistrate Judge's Report and Recommendation (Doc. #4) is ADOPTED in part. Plaintiff's Complaint (Doc. #1) is DISMISSED and the claims against State Attorney Sara Macks are DISMISSED with prejudice. The Clerk of Court is DIRECTED to strike Plaintiff's amended Complaint (Doc. #8). Plaintiff's Motion to Proceed In Forma Pauperis (Doc. #2) is DENIED without prejudice. The Court grants Plaintiff an opportunity to file a second amended complaint that corrects the deficiencies outlined in the Report and Recommendation (Doc. #4). Failure to file a second amended complaint within 30 days from the date of this Order will result in the dismissal of this case without further notice.
