ENDORSED ORDER denying #24 Motion to Dismiss. The Court has reviewed all pleadings and this record. 1. As To Service: The Court concludes Astrobryxa is served pursuant to Fed. R. Civ. P. 4. Out of an abundance of caution, the Court also orders Plaintiff to employ the alternate means of service suggested in a page 9-10 of Plaintiff's Response, filing proof of same. This comports with due process and minimizes offense to foreign law. Further, also out of an abundance of caution the Court orders Plaintiff to expedite service pursuant to the appropriate MLAT treaty/agreement with the country of Ecuador. If this MLAT task is fruitless or futile, Plaintiff should file a declaration explaining why. Finally, allegations are made here that Astrobryxa is a "sham company" and one or more parties related to Astrobryxa may be unavailable or concealing their whereabouts. Therefore, given that personal jurisdiction exists (see discussion, below) the Court also orders Plaintiff to serve process on Astrobryxa via Fla. Stats. 48.161. 2. As to personal jurisdiction: Personal jurisdiction is established over Astrobryxa in this forum. The allegations are that a fraud was undertaken in this District and in Ecuador, involving payments into this District, documents created and/or sent from this District (one or more alleged to be forged re. a Lakeland company) and domestic coconspirators domiciled here. Specifically the complaint alleges that a Polk County, Florida company ("Progen") acting through Polk County, Florida residents paid Astrobryxa $20 million of the fraud proceeds to assist with perpetrating the fraud. Whether judged by the Florida long-arm statute of Fla. Stats. 48.193(1)(a)(1) or (2) or otherwise, ample and sufficient torts or injury touching on this District (whether by principal or agent) and alleged conspirators' minimum contacts with Florida are pled. It is consistent with due process for Astrobryxa to be haled into this forum to defend. Besides specific jurisdiction, the activities alleged include agents of Astrobryxa engaging in substantial and not isolated activities within Florida. Id. at (9)(2). Signed by Judge William F.
