ENDORSED ORDER re: #12 Plaintiffs' Motion for Leave of Court to Proceed Using Initials as Pseudonyms. Considering the totality of the circumstances as set forth in In re Chiquita Brands Int'l, Inc., 965 F.3d 1238, 1247 (11th Cir. 2020) (per curiam)--and particularly in light of allegations regarding S.H.'s mental health struggles as a minor and Plaintiffs' representation that Defendants already possess Plaintiffs' full identities--the Court finds that allowing Plaintiffs to proceed under pseudonyms at this time is appropriate. See also Doe v. Georgia Dept. of Corrections, 2024 WL 5200055, *2 (Dec. 23, 2024) (per curiam) (upholding a plaintiff's request to file anonymously, including because issues of "mental illness" give rise to "a substantial privacy interest"). Accordingly, Plaintiffs' motion to proceed by pseudonym is granted at this time for purposes of pretrial proceedings. This Order is subject to reconsideration, however, upon Defendants' motion or if the Court otherwise determines that revisitation is necessary, including for purposes of trial. If Defendants object, they shall file a motion challenging Plaintiffs' desire to proceed pseudonymously within thirty days of their first appearance. Plaintiffs' motion is otherwise denied. Signed by Magistrate Judge Christopher P. Tuite on 2/6/2026. (ACL)
