| Filing 8 NOTICE of Local Rule 1.11(e), which provides that, unless an order states another time, a seal under Rule 1.11 expires ninety days after a case is closed and all appeals are exhausted. To prevent the content of a sealed item from appearing on the docket after the seal expires, a party or interested non-party must move for relief before the seal expires. (Signed by Deputy Clerk). ENDORSED ORDER: Plaintiff voluntarily dismisses this action under Rule 41(a)(1)(A)(i), Fed. R. Civ. P. (Doc. #6). Because no Defendant answers or moves for summary judgment, the notice of voluntary dismissal is self-executing. See Fed. R. Civ. P. 41(a)(1)(A)(i); Matthews v. Gaither, 902 F.2d 877, 880 (11th Cir. 1990). The Clerk is directed to terminate any deadlines and pending motions, and to CLOSE this case. Signed by Judge Kathryn Kimball Mizelle on 1/22/2026. (GTD)

| Filing 5 SUMMONS issued as to Metropolitan Life Insurance Company. (LJC) |
| Filing 4 NOTICE TO COUNSEL Geannina A. Burgos, Edward P. Dabdoub of Local Rule 2.02(a), which states, "The first paper filed on behalf of a party must designate only one lead counsel who - unless the party changes the designation - remains lead counsel throughout the action." Counsel must file a Notice of Lead Counsel Designation identifying lead counsel. (Signed by Deputy Clerk). (LJC) |
Filing 3
ENDORSED ORDER: Upon review the Court notes that it is unclear from the complaint how venue is proper in this District. The plaintiff sues under Oklahoma law, is a citizen of Oklahoma, and resides in "Oklahoma County, Florida." The defendant is alleged to be a citizen of New York, and there are no allegations that make venue proper here. The closest the complaint comes is with the general allegation that the defendant has "physical offices located in Florida." Where these offices are in Florida and how they relate to the matter at hand is unclear. No later than January 28, 2026, the plaintiff must, in a paper no longer than seven pages, show cause why the Court should not dismiss for improper venue. See 28 U.S.C. 1406(a). Alternatively, no later than January 28, 2026, the plaintiff may file an amended complaint with allegations clearly establishing that venue is proper in this District. Failure to do either will result in the dismissal of this action without prejudice. Signed by Judge Kathryn Kimball Mizelle on 1/21/2026. (GTD)
