Date Filed Document Text

March 3, 2026 Opinion or Order Filing 9 ENDORSED ORDER: The plaintiff's #3 motion to consolidate this case with the plaintiff's active case, 25-cv-2949-KKM-CPT Mathis et al v. AML Services Corp. et al, is DENIED. The plaintiff's complaint is DISMISSED because it is a shotgun pleading, see Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1321, 1324 (11th Cir. 2015) ("The most common type [of shotgun pleading]--by a long shot--is a complaint containing multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint."). Further, the complaint, in concert with the motion to consolidate, is an attempt to circumvent the requirements of Rule 15(a)(2) of the Federal Rules of Civil Procedure and the Court's previous order in case no. 25-cv-2949. See (Doc. 24). If the plaintiff wishes to amend his complaint in case no. 25-cv-2949, he must move for leave to do so within that case. Efforts to avoid Rule 15 or this Court's orders will not be tolerated. The clerk is directed to ENTER JUDGMENT, which shall read "This case is dismissed without prejudice." The clerk is directed to TERMINATE any pending motions and CLOSE this case. Signed by Judge Kathryn Kimball Mizelle on 3/3/2026. (GTD)
