ENDORSED ORDER: Upon sua sponte review, the Court finds that the amended complaint (Doc. #5) constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1324 (11th Cir. 2015). Specifically, some of the twelve counts improperly reallege all preceding paragraphs, resulting in counts that contain irrelevant factual allegations and legal conclusions. See id. at 1321 ("The most common type [of shotgun pleading]--by a long shot--is a complaint containing multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint."). Further, the complaint "is guilty of the venial sin of being replete with conclusory, vague, and immaterial facts not obviously connected to any particular cause of action." Id. at 1321-22. Federal Rule of Civil Procedure 8(a) requires that a complaint include "a short and plain statement of the claim showing that the pleader is entitled to relief." The amended complaint sprawls across 17 pages and 258 paragraphs, asserting claims under 42 U.S.C. 1983 and the ADA, all based on the same allegations, many of which are conclusory statements and legal conclusions devoid of factual support. "Even under the most generous and lenient application of Rule 8, the complaint is decidedly improper and impermissible." Trump v. New York Times Co., 800 F. Supp. 3d 1297, 1298 (M.D. Fla. 2025). Accordingly, the Amended Complaint is DISMISSED, and Plaintiff is granted leave to amend his complaint no later than April 20, 2026. If Plaintiff fails to amend the complaint or submit another shotgun pleading, this action may be dismissed without further notice. Plaintiff's motion to submit a USB (Doc. #4) and motion for preliminary injunction (Doc. #2) are DENIED as moot. Signed by Judge William F. Jung on 3/30/2026. (SZC)
