Date Filed Document Text
June 1, 2026 Filing 12 NOTICE of Local Rule 1.11(e), which provides that, unless an order states another time, a seal under Rule 1.11 expires ninety days after a case is closed and all appeals are exhausted. To prevent the content of a sealed item from appearing on the docket after the seal expires, a party or interested non-party must move for relief before the seal expires. (Signed by Deputy Clerk). (LAW)
May 26, 2026 Opinion or Order Filing 11 ORDER: For the reasons explained in the attached order, the Clerk is directed to REMAND this action to the Circuit Court for the Sixth Judicial Circuit in and for Pinellas County, Florida, and to TRANSMIT a certified copy of this order to the clerk of that court. The Clerk is further directed to TERMINATE any pending deadlines, motions, or hearings, and to CLOSE this case. Signed by Judge Kathryn Kimball Mizelle on 5/26/2026. (GTD)
May 26, 2026 Filing 10 STIPULATION re 9 Order by BW CW Hospitality LLC, Hyatt Corporation. (Sausaman, Alison)
May 21, 2026 Opinion or Order Filing 9 ENDORSED ORDER: In response to the Court's order (Doc. 7) to refile the notice of removal with properly pleaded citizenship, the removing defendant, Hyatt Corporation, filed a joint stipulation for remand. (Doc. #8). The joint stipulation does not provide any grounds for remand beyond the parties' apparent agreement. Hyatt Corporation is directed to file, no later than May 25, 2026, another joint stipulation that briefly sets out the grounds for remand or identifies authority that allows the Court to remand based on the agreement of the parties alone. Signed by Judge Kathryn Kimball Mizelle on 5/21/2026. (GTD)
May 20, 2026 Filing 8 Joint STIPULATION for Remand to State Court by Hyatt Corporation. (Sausaman, Alison) Modified on 5/21/2026 to edit the docket text (MLB).
May 15, 2026 Opinion or Order Filing 7 ENDORSED ORDER: The notice of removal (Doc. #1) fails to adequately plead the citizenship of all parties. Specifically, it does not plead the citizenship of each member of defendant BW CW Hospitality, LLC. Instead, it merely states that none of the defendant's members are citizens of Florida, but this is insufficient for determining that there is complete diversity because the plaintiff is not alleged to be a citizen of Florida. The removing defendant, Hyatt Corporation, is directed to refile the notice of removal after properly pleading the citizenship of each member of the BW CW Hospitality, LLC, no later than May 20, 2026. The Court also directs Hyatt Corporation to review the dates throughout the notice of removal and confirm or correct them as needed because the notice of removal purports to have been signed on March 17, 2025, calling into question the accuracy of the other dates, most of which are also listed as 2025. Signed by Judge Kathryn Kimball Mizelle on 5/15/2026. (GTD)
