ENDORSED ORDER: The Eleventh Circuit has held that an order dismissing a complaint with leave to amend within a specified time becomes a final judgment when the plaintiff misses that deadline to amend without seeking an extension of time. See Auto. Alignment & Body Serv., Inc. v. State Farm Mut. Auto. Ins. Co., 953 F.3d 707, 719-20 (11th Cir. 2020). The Court previously dismissed Plaintiff's complaint and granted leave to amend on or before July 7, 2026. See (Doc. 6). Plaintiff has failed to file an amended complaint by the deadline, so the Court's June 16, 2026, Order constitutes a final judgment. ORDER: The report and recommendation (Doc. #5) is affirmed and adopted and incorporated by reference into this Order for all purposes, including appellate review. The complaint (Doc. #1) is dismissed without prejudice. Plaintiff's motion to proceed in forma pauperis (Doc. #2) is denied without prejudice. Plaintiff is directed to file an amended complaint that corrects the defects identified in the report and recommendation on or before July 7, 2026. Failure to do so will result in this Order becoming a final judgment. In addition, Plaintiff is directed to either pay the filing fee or file a new motion to proceed without costs at the time she files her amended complaint.
