TEXT ORDER. Plaintiff Welselly Santana's Complaint (Doc. #1) is DISMISSED without leave to amend because her claim is frivolous. Plaintiff alleges that the Court has subject matter jurisdiction to adjudicate her claim because it involves a federal question, but that is false. Specifically, Plaintiff claim asserts that she is entitled to funds from a trust, but the statutes she cites relate only to federal grants, taxes, and treaties. (Id. at 3). Moreover, the Court notes that this is one of many frivolous lawsuits that Plaintiff has brought in this District recently. (See Doc. 14 at 2, Santana v. Central Intelligence Agency, No. 8:26-cv-00768 (M.D. Fla. May 5, 2026). This case is patently frivolous and due to be dismissed, without leave to amend. See Neitzke v. Williams, 490 U.S. 319, 327 (1989) (20 U.S.C. 1915 "accords judges not only the authority to dismiss a claim based on an indisputably meritless legal theory, but also the unusual power to pierce the veil of the complaint's factual allegations and dismiss those claims whose factual contentions are clearly baseless."). Accordingly, the Clerk of Court is DIRECTED to deny any pending motions as moot, terminate any deadlines, and close the case. Signed by Judge John L. Badalamenti on 5/22/2026. (CAR)
