June 15, 2026 Opinion or Order Filing 7 TEXT ORDER. Plaintiff's Complaint (Doc. #1) is DISMISSED without prejudice as an impermissible shotgun pleading. The Complaint "contain[s] multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint." (Doc. #1 at paras. 78, 83, 88, 93, 99, 106, 112, 117, 120, 124, 129, 136, 146, 152, 157, 163, 167, 171, 174, 179); Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1321 (11th Cir. 2015). Additionally, several of the counts contained in the Complaint fail to specify against which of the many defendants they are brought. (See Doc. #1 at paras. 89, 97, 102, 107, 114, 118, 126, 149, 172); Weiland, 792 F.3d at 1323 (explaining that a complaint "asserting multiple claims against multiple defendants without specifying which of the defendants are responsible for which acts or omissions, or which of the defendants the claim is brought against" is a shotgun pleading). Finally, some of Plaintiff's factual allegations span close to a page in length with no break, which makes it impossible for Defendants to "discern what he is claiming and frame a responsive pleading." (See, e.g., Doc. 1 at paras. 33, 36, 40, 79, 80, 96); Weiland, 792 F.3d at 1320 (quoting T.D.S. Inc. v. Shelby Mut. Ins. Co., 760 F.2d 1520, 1544 n.14 (11th Cir. 1985)). Accordingly, Plaintiff's Complaint (Doc. #1) is DISMISSED without prejudice. Plaintiff shall have leave to file an amended complaint. Should Plaintiff do so, Plaintiff must file such within fourteen (14) days from the date of this Order. No additional claims may be raised in any amended complaint. See Fed. R. Civ. P. 15(a)(2) ("The court should freely give leave when justice so requires."); Silberman v. Miami Dade Transit, 927 F.3d 1123, 1132 (11th Cir. 2019) ("A pro se plaintiff must be given at least one chance to amend the complaint before the district court dismisses the action with prejudice[.]"). Failure to timely file an amended complaint may result in the dismissal of this action without further notice. Accordingly, Plaintiff's Motion to Proceed In Forma Pauperis (Doc. #4) is DENIED as moot. Signed by Judge John L. Badalamenti on 6/15/2026. (CAR)
