Although the first sentence of the amended complaint states that Plaintiff brings this action "[p]ursuant to Rule 15(a)(2)" (Doc. #21 at 1), this is not sufficient. To comply with Rule 15(a)(2), Plaintiff must obtain either the opposing party's written consent or leave of Court. Fed. R. Civ. P. 15(a)(2). Plaintiff has not obtained leave of Court or demonstrated that he has obtained the opposing party's written consent to file the amended complaint. Accordingly, the amended complaint is stricken.
