June 24, 2026 Opinion or Order Filing 6 ENDORSED ORDER: Petitioner initiated this action by filing #1 a pro se petition for writ of habeas corpus and #2 a motion to appoint counsel. Although the petition was filed in the Fort Myers Division, it was transferred #4 to the Tampa Division based on a finding that Petitioner sought to challenge "the validity of his convictions and sentence," which "occurred in Polk County, Florida." Upon further review, the Court has determined that Petitioner's convictions were entered in Highlands County, not Polk County. See State v. Smith, No. 1990-CF-279 (Fla. 10th Jud. Cir. Ct.); State v. Smith, No. 1989-CF-506 (Fla. 10th Jud. Cir. Ct.). Because the state court that entered the convictions is located in the Southern District of Florida, transfer of this action to the Southern District of Florida is appropriate in the interest of justice. See 28 U.S.C. 1631, 2241(d). Accordingly, the Clerk is DIRECTED to transfer this action to the United States District Court for the Southern District of Florida and to CLOSE this case.
