Section 2254 was dismissed without prejudice as premature. Petitioner now asks the Court to advise him on the time remaining to re-file his petition. The Court cannot advise Booth on the timeliness of future pleadings. However, as stated in the Court's dismissal order, a one-year statute of limitations applies to a Section 2254 petition, and the limitation period tolls when a properly filed application for state post-conviction relief is pending. 28 U.S.C.
