Filing 3
ENDORSED ORDER: Petitioner, a state pretrial detainee, initiated this action by filing #1 a pro se petition for writ of habeas corpus under 28 U.S.C. 2241 and #2 a motion to proceed in forma pauperis. Petitioner faces state criminal charges for armed trafficking of amphetamine, possession of a firearm by a felon, and grand theft. State v. Raburn, No. 24-CF-13399 & No. 24-CF-13417 (Fla. 13th Jud. Cir. Ct.). As the Court explained to Petitioner when it dismissed his earlier habeas petition, nothing in his filings demonstrates "extraordinary circumstances" warranting a departure from the principle that federal courts "should abstain from deciding issues implicated in an ongoing criminal proceeding in state court." Raburn v. Jeremiah, No. 8:26-cv-652-WFJ-SPF, Doc. 2 at 2 (M.D. Fla.). For this reason, the Court declines to intervene in Petitioner's state-court proceedings. Therefore, the petition is DISMISSED without prejudice, and the motion to proceed in forma pauperis is DENIED as moot. A certificate of appealability and leave to appeal in forma pauperis are DENIED. The Clerk is directed to CLOSE this case. Signed by Judge William F. Jung on 6/26/2026. (MWC)
