ENDORSED ORDER: Upon review, the Court finds this complaint constitutes an impermissible shotgun pleading. See Weiland v. Palm Beach Cnty. Sheriff's Off., 792 F.3d 1313, 1324 (11th Cir. 2015). Specifically, the second count improperly "incorporates and adopts by reference the allegations in" the first count thus causing the second count to contain irrelevant factual allegations and legal conclusions. See id. at 1321 ("The most common type [of shotgun pleading]--by a long shot--is a complaint containing multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint."). The complaint also lumps all of the defendants' actions together in conclusory fashion and thus fails to "specify[] which of the defendants are responsible for which acts," see id. at 1323, or "identify [the factual basis for the] claims with sufficient clarity" as to each unique credit report "to enable [each] defendant to frame" a responsive pleading. See Sledge v. Goodyear Dunlop Tires N. Am., Ltd., 275 F.3d 1014, 1018 (11th Cir. 2001). Accordingly, the Plaintiff's complaint is DISMISSED, and the Plaintiff is granted leave to amend the complaint no later than September 23, 2026. The plaintiff's motion to proceed in forma pauperis (Doc. #2) is DENIED without prejudice as moot. If the Plaintiff fails to amend the complaint or submits another shotgun pleading, this action will be dismissed without further notice. Signed by Judge Kathryn Kimball Mizelle on 9/9/2026. (DRD)
