ENDORSED ORDER: Plaintiff, a pretrial detainee, initiated this action by filing #1 a pro se civil rights complaint under 42 U.S.C. 1983. Plaintiff is awaiting trial in Florida state court on a charge of resisting an officer with violence. State v. Redbrook, No. 25-CF-7005 (Fla. 13th Jud. Cir. Ct.). In his complaint, Plaintiff asserts a claim for malicious prosecution, alleging that his criminal charge is unlawful because he was having a "medical emergency" when he was arrested. Upon review, 28 U.S.C. 1915A, the Court concludes that this action must be dismissed without prejudice. To pursue a malicious prosecution claim, Plaintiff must establish (among other things) that "the criminal proceedings against him terminated in his favor." Luke v. Gulley, 975 F.3d 1140, 1144 (11th Cir. 2020). As explained above, Plaintiff's criminal case is ongoing. Therefore, he fails to meet the favorable termination requirement, and the malicious prosecution claim must be dismissed without prejudice as premature. See Heck v. Humphrey, 512 U.S. 477, 489 (1994) ("[A] cause of action for malicious prosecution does not accrue until the criminal proceedings have terminated in the plaintiff's favor."). The Clerk is directed to enter judgment against Plaintiff, terminate any pending motions as moot, and close this case. Signed by Judge William F. Jung on 9/16/2026. (MWC)
