ENDORSED ORDER: The complaint (Doc. #1) invokes this Court subject-matter jurisdiction under 28 U.S.C. 1332(d). To establish jurisdiction under Section 1332(d), the plaintiff must plausibly allege that "the aggregate amount in controversy exceeds $5,000,000" and that "the proposed plaintiff class contains at least 100 members." See Smith v. Verra Mobility Corp., No. 8:25-CV-2300-KKM-NHA, 2026 WL 1673830, at *4 (M.D. Fla. June 10, 2026) (citation omitted). Without any elaboration as to the damages per putative class member, the complaint alleges that the "[t]he amount in controversy exceeds $5,000,000... for the putative Class" and that thousands of putative class members exist. See Compl. 10, 73. Yet "conclusory allegations that [Section 1332] is satisfied [do] not suffice" to establish this Court's jurisdiction. See Progressive Mountain Ins. Co. v. Middlebrooks, 805 F. App'x 731, 737 (11th Cir. 2020) (citing Williams v. Best Buy Co. , 269 F.3d 1316, 1319-20 (11th Cir. 2001)). Beyond that, the plaintiff fails to allege any facts suggesting that the amount in controversy exceeds $75,000 for her individual claims. See 28 U.S.C. 1332(a). In the light of these limited allegations, I am skeptical that the plaintiff has plausibly alleged facts to invoke this Court's subject-matter jurisdiction under Section 1332. I thus order the plaintiff to show cause why her complaint should not be dismissed for lack of subject-matter jurisdiction, in a brief not to exceed ten pages, no later than September 24, 2026.
