March 5, 2026 Opinion or Order Filing 12 ORDER: Video motion hearing held on movant Philip Brewster's motion to quash subpoena, R. 4. Brewster appeared for himself and counsel for the parties in the underlying case appeared by video. As discussed during the hearing, over the objection of Brewster and the mild objection of the Washington Post, the motion to quash is transferred to the Middle District of Florida under Federal Rule of Civil Procedure 45(f). Under Civil Rule 45(f), exceptional circumstances justify transfer: first, it is exceedingly rare to subpoena an attorney for a deposition arising from the attorney's representation of a client. No doubt attorney-client privilege disputes will arise, some of which are already teed up by the motion to quash. Attorney-client privilege disputes typically turn on specific facts rather than differences in substantive privilege law across districts or states. There is no reason to doubt that will happen here, so the court presiding over the underlying claim will be far better positioned to decide the motion. Also, the privilege disputes arise out of Brewster's years-long representation of Will Wilkerson in a variety of settings amongst a variety of agencies and cases. It would be one thing if the basis for the privilege dispute was a precise, limited representation. It is quite another to litigate and to decide privilege disputes in this much broader context. Second, this dispute arises with discovery closing in 8 calendar days, after a short extension. There will be not only pre-deposition disputes, but also almost surely postdeposition discovery disputes over assertions of the privilege during the deposition (if the deposition is allowed to occur). The Court is reluctant to effectively force an extension of the discovery deadline of the issuing court, so this too gives rise to an exceptional circumstance. Indeed, it is not clear how the timing of the subpoena arose as to Brewster; the Plaintiff identified in the extension motion that Wilkerson had been on prior deponent lists and was the subject of conferrals, R. 144 at 5 (M.D. Fla. docket), so there was fair warning that he would be deposed. But Brewster was not similarly mentioned as being part of a prior list or prior conferral. Obviously there was good cause for the slight extension, but this Court is not in a position to apply that finding further. Instead, the issuing court is in a far superior position to decide the motion to quash and to preside over its aftereffects. The motion to quash is hereby ordered transferred FORTHWITH to the Middle District of Florida, with the recommendation that it be made part of the pending case, Trump Media & Technology Group Corp. v.
