The magistrate judge's Report and Recommendation (doc. 35 ) is adopted and incorporated by reference in this order. 2. The Motion for Attorney Fees pursuant to 42 U.S.C. § 406(b) ( Doc. 32 ) is GRANTED. 3. Plaintiffs counsel, John M. Pennington, is awarded attorney's fees in the amount of $16,407.00, to be paid out of the sums withheld by the Commissioner from Plaintiffs past due benefits. 4. Upon receipt of attorne y's fees in the amount of $16,407.00 pursuant to 42 U.S.C. § 406(b), Plaintiffs counsel, John M. Pennington, Esquire, is entitled to recover fees in the amount of $2,521.73, for representing Plaintiff before the United States District Court for the Northern District of Florida pursuant to 28 U.S.C. § 2412 (EAJA); the amount of attorney fees and hourly rates requested under the EAJA are reasonable; and the Commissioner is directed to pay counsel that amount. This case is REMANDED to the Commissioner of Social Security pursuant to sentence four of 42 U.S.C. § 405(g). Plaintiff's case is to be assigned to a new ALJ upon remand. That ALJ who presided over Plaintiff's administrative hearing will be provided with a copy of the Report and Recommendation 23 , as was done in Case Number 3:07cv509/RV/EMT.
