ORDER. CUNA's motion to dismiss 6 is GRANTED in part and DENIED in part. Specifically, the motion is DENIED with respect to count V, but the motion is GRANTED with respect to counts VI and VII. Those latter claims are DISMI SSED, without prejudice. The plaintiff shall have fourteen (14) days in which to file an amended complaint, in lieu of which dismissal of counts VI and VII (with respect to CUNA) shall be with prejudice.
