Filing 166 ORDER adopting the magistrate judge's 157 Report and Recommendation. Grice's 142 Motion to Set Aside Default is GRANTED. Plaintiff's 153 Motion for Default Judgment is DENIED as moot. The 129 Moti on to Dismiss filed by Defendants Temples and FDOC is GRANTED and the federal claims against these Defendants are dismissed with prejudice. All federal claims against Defendants Kelley, Nelson, Morris, Hammontree; Orsa; Turner; Ealum; Mitchell; C ollier; Grice; Bishop, and SRCI, are also dismissed with prejudice. Plaintiff's state law claims against all Defendants are dismissed without prejudice to Plaintiff's pursuing them in state court. Any other pending motions are DENIED as moot.
