ORDER DENYING REMAND AND COMPELLING ARBITRATION. Plaintiffs motion to remand to state Court (Doc. #8 ) is DENIED. Defendants' motion to file a reply in support of the motion to compel arbitration (Doc. #13 ) is DENIED. Defendants motion to compel arbitration (Doc. #6 ) is GRANTED, and the parties are directed to arbitrate the claims asserted in the amended complaint in accordance with the Dispute Resolution Agreement. This case is STAYED pending completion of the arbitration, and the parties shall file a joint report 180 days from the date of this Order (and every 60 days thereafter) regarding the status of the arbitration. ORDER re #9 Motion to Stay. The request to extend the deadline for responding to the motion to compel arbitration is DENIED because that motion will need to be promptly ruled on even if this case is remanded to the state court, and the Court sees no harm in the briefing of that motion being completed sooner rather than later. This Court will, of course, rule on the motion to remand before addressing the motion to compel arbitration. The request to stay the deadlines in the initial scheduling order (Doc. #3 ) is GRANTED, and all the deadlines in that order are tolled pending disposition of the motion to remand and, if the case is not remanded, the motion to compel arbitration.
