ORDER granting #6 Unopposed MOTION To Stay Action Pending Arbitration, as follows: The Plaintiff is directed to file an amended complaint substituting Transform Sears Home Services LLC as the Defendant; all claims against Sears, Roebuck and Company are subject to the automatic stay of the bankruptcy court. On filing of the Amended Complaint, the case will be STAYED pending arbitration, pursuant to the parties' agreement, and the Clerk is directed to administratively close the file at that time as well. The Court reserves jurisdiction, and the case will be reopened on motion of either party, for the purposes of enforcing, modifying or vacating any the arbitration award between the parties.
