TEXT ORDER shortening response deadline as to #14 Motion for Leave to File Second Amended Complaint to 03/19/2021, and reply deadline to 03/23/2021. Defendant previously filed #7 Motion to Dismiss or in the Alternative to Transfer, as to which Plaintiff filed #9 Response and Defendant filed #10 Reply. In reviewing #7 Motion, the Court took note of a gap in the allegations of #3 Amended Complaint regarding Plaintiff's citizenship, which impacted the existence of subject matter jurisdiction. Because of the Court's independent duty to ensure the existence of subject matter jurisdiction, the Court entered #13 Order directing Plaintiff either to move for leave to amend its pleading to address the noted gap regarding its citizenship or to file a memorandum explaining why subject matter jurisdiction existed notwithstanding that gap. Plaintiff thereafter elected to file #14 Motion, proposing to file [14-1] Second Amended Complaint, addressing the noted gap regarding its citizenship. Because the proposed amendment does not alter the allegations at issue in #7 Motion, the Court anticipates treating #7 Motion as applying equally against [14-1] Second Amended Complaint (if allowed to be filed), without need of re-filing of #7 Motion, #9 Response, and #10 Reply. As a result, the Court does not deem it necessary to resolve any alleged futility challenge to #14 Motion, premised on the grounds articulated in #7 Motion, in advance of a ruling on #14 Motion. To the extent Defendant opposes #14 Motion on some other ground, it may so state in the shortened response time established herein, with the time for any reply likewise reduced.
